XactiScope LLC Service Agreement By checking the box the user agrees/accepts the applicable terms and conditions, and by checking the box this means you accept, understand and agree to the service pricing chart provided on www.XactiScope.com/pricing. Validation Agreement By checking the box the user agree to allow his/her/their insurance carrier to discuss the claim with XactiScope LLC Employee(s) or contractors on their behalf. Guarantor/Guarantee of Payment Provision Guarantee Provision: (a) Each Guarantor signing below in the place designated “Guarantor” hereby agrees that for the consideration of XactiScopes LLC Services extending credit to the client, the undersigned Guarantor (s) hereby absolutely, unconditionally and irrevocably guarantee payment of all the amount hereafter owed to XactiScope LLC by client, which the Guarantor agrees to pay as they invoice to their customer/client or balance paid in full no later than 90 days from XactiScopes LLC estimate original completion date. Guarantor agrees to pay full amount owed to XactiScope LLC based off Replacement Cost Value Amount unless an agreed upon amount that is in writing and signed by both parties. (b) Gaurantor waives (i) notice of the acceptance of this Guaranty; (ii) notice of extension of credit to the Client; (iii) presentment, protest, notice, demand, or action with respect to any default on payment of all or any part of the indebtedness with respect to any default by Guarantor in Guarantor’s obligations under guaranty; (iv) any rights to require XactiScopes LLC services to first pursue Client for the collection of the balance due from its Client; (d) Guarantor waives any and all defense, claims and discharges of the Client or any defenses regarding the indebtedness , excepting only the defense of the discharge by payment to XactiScope LLC; (e) The Guarantor agrees the his or her signature shall be continuing and absolute and shall not in any manner be impaired by any modification, extension or amendment of any terms, conditions or agreement between XactiScope LLC and the Client. This is a guarantee of payments and the liability of the Guarantor hereunder is direct and unconditional. Client and Guarantor agree to waive and all jurisdiction and venue requirements that may otherwise be imposed upon the parties’ pursuant to the statutes of the state; Alabama Court Rules and/or any case law interpreting said rules and statutes and agrees to be bound to resolve and disputes in Lauderdale County Alabama. Guarantor agrees to pay all court cost, fees in collections and 20% of the total balance owed to XactiScope or 20% of the total amount order by the courts to the attorney or law firm representing XactiScope LLC.
